Terms & Conditions
Effective date: September 21, 2026
These Terms and Conditions govern your use of the Build Your English Academy website and your participation in lessons, courses, consultations, assessments, workplace training, and other services offered by Build Your English Academy.
In these Terms, “Build Your English Academy,” “the Academy,” “we,” “us,” and “our” refer to Build Your English Academy. “Student,” “client,” “company,” “you,” and “your” refer to the individual or organization purchasing, accessing, or participating in our services.
By booking or purchasing a service, submitting an enrollment form, accepting a proposal, or participating in a service, you agree to these Terms and Conditions.
1. Services
Build Your English Academy provides services that may include:
-
Private English lessons;
-
Group English classes;
-
Workplace and company training;
-
Consultations and language assessments;
-
Personalized learning plans;
-
Educational materials and digital resources; and
-
Other language-learning services described on our website or in a written proposal.
The content, schedule, instructor, delivery method, and length of a service may vary depending on the program selected.
For workplace training, the scope of services may be described in a separate proposal, service agreement, or contract. If that document contains terms that differ from these general Terms and Conditions, the company-specific written agreement will take priority.
2. Eligibility and Minors
You must be at least 18 years old to purchase services from Build Your English Academy.
Students under 18 may participate only with the permission of a parent or legal guardian. The parent or guardian will be responsible for payment, scheduling, communication, and acceptance of these Terms on the student’s behalf.
3. Registration and Information
Students and clients agree to provide accurate and current information when registering, booking, or purchasing services.
You are responsible for informing Build Your English Academy about information that may reasonably affect instruction, scheduling, communication, or a student’s ability to participate safely and effectively.
We reserve the right to decline or discontinue services when we cannot reasonably meet a student’s needs, when required information has been intentionally misrepresented, or when participation would create a safety or operational concern.
4. Payments
Prices will be displayed on our website, booking platform, invoice, or company-specific proposal.
Unless otherwise stated:
-
Payment is due before the lesson, course, assessment, or training begins.
-
Lesson packages must be paid for in full before the first included lesson.
-
Company payment schedules will be listed in the applicable invoice, agreement, or proposal.
-
Students and clients are responsible for any applicable taxes or clearly disclosed transaction fees.
-
Prices may change, but a price change will not affect services that have already been purchased.
Build Your English Academy will not automatically renew a package or recurring service unless automatic renewal is clearly disclosed and separately authorized. Any automatic-renewal service will include instructions for cancellation as required by applicable law.
5. Scheduling
Lessons and training sessions are scheduled based on instructor and student availability.
A scheduled time is not guaranteed until the booking has been confirmed. Students and clients are responsible for checking confirmation messages and attending at the correct date and time.
Unless otherwise stated, all scheduling times are based on the time zone shown during booking or in the applicable agreement.
6. Cancellations and Missed Services
Cancellations, rescheduling requests, and refunds are governed by the Build Your English Academy Refund and Cancellation Policy, which is incorporated into these Terms.
In general:
-
Individual lessons may be canceled or rescheduled without charge with at least 2 hours’ notice.
-
An individual lesson canceled with less than 2 hours’ notice, or missed without notice, may be charged at 50% of its regular price.
-
Group enrollment may be canceled with at least 12 hours’ notice before the first scheduled class.
-
Late cancellation or nonattendance for an individual group class may result in a charge equal to 50% of the amount allocated to that class.
-
Workplace training may be canceled or rescheduled without charge with at least 12 hours’ notice.
-
A company canceling with less than 12 hours’ notice may be charged up to 50% of the scheduled service’s cost, depending on the preparation already completed.
-
Different workplace-training terms may apply when stated in a company-specific agreement or proposal.
If a prepaid service is subject to a 50% late-cancellation charge, the remaining 50% may be refunded or issued as an account credit.
Reasonable exceptions may be considered for emergencies or unexpected circumstances.
7. Lesson Packages
Lesson packages are valid for the period stated when purchased. If no expiration period is stated, students should contact Build Your English Academy for confirmation before purchasing.
Students may request a refund for the unused portion of a package after the first lesson, provided the request is submitted at least 24 hours before the second scheduled lesson.
The completed lesson may be deducted at the regular individual-lesson rate. Additional conditions are explained in the Refund and Cancellation Policy.
Packages may not be transferred to another person without prior written approval.
8. Student Responsibilities
Students agree to:
-
Attend lessons on time;
-
Participate respectfully;
-
Complete independent practice when appropriate;
-
Communicate scheduling changes promptly;
-
Use course materials only for personal educational purposes;
-
Avoid recording or distributing lessons without permission; and
-
Refrain from disruptive, discriminatory, threatening, or inappropriate conduct.
Language improvement depends heavily on attendance, participation, and practice outside scheduled lessons.
9. Company Responsibilities
Companies purchasing workplace training agree to provide:
-
Accurate information about the number of participants and their learning needs;
-
A safe and appropriate training environment;
-
Reasonable access to the training location or online platform;
-
Any equipment or facilities assigned to the company under the proposal; and
-
Timely communication regarding scheduling or staffing changes.
The company is responsible for ensuring that participating employees understand applicable attendance and conduct expectations.
10. Online Lessons and Technology
Students participating online are responsible for having:
-
A reliable internet connection;
-
A working computer, tablet, or other compatible device;
-
Functional audio equipment; and
-
Access to the agreed-upon video or learning platform.
Build Your English Academy is not responsible for interruptions caused by a student’s device, internet connection, software, or environment.
If a significant technical issue originates from Build Your English Academy and prevents a lesson from being delivered, the lesson will be rescheduled or refunded without penalty.
11. Recording and Privacy During Lessons
Students and clients may not record, photograph, transcribe, livestream, or distribute a lesson or training session without prior permission.
Build Your English Academy will not record a lesson without notifying the participants and obtaining any consent required by law.
Students should avoid sharing highly sensitive personal, financial, medical, or immigration information during lessons unless it is necessary and appropriate for the service.
Our collection and handling of personal information are also governed by our Privacy Policy.
12. Educational Materials and Intellectual Property
Unless otherwise stated, lesson plans, worksheets, assessments, recordings, presentations, digital downloads, website content, branding, and other materials created by Build Your English Academy are owned by or licensed to the Academy.
Students and clients receive a limited, personal, nonexclusive right to use supplied materials for their own learning or internal employee training.
Materials may not be:
-
Resold or commercially distributed;
-
Published online;
-
Shared publicly;
-
Reproduced for use by individuals who were not included in the purchase;
-
Presented as the purchaser’s original work; or
-
Modified and sold as a separate product.
Companies may make reasonable internal use of materials when that use is expressly included in their proposal or service agreement.
13. No Guaranteed Results
Build Your English Academy will provide instruction and support in good faith, but we cannot guarantee a particular result.
Results may depend on attendance, participation, prior education, practice, individual ability, workplace opportunities, and other circumstances outside our control.
Our services do not guarantee:
-
Fluency within a particular period;
-
A particular test score;
-
Employment or promotion;
-
Admission to a school or program;
-
Professional licensing or certification; or
-
Any immigration or legal outcome.
14. No Legal, Immigration, or Employment Advice
English instruction and general educational support do not constitute legal, immigration, tax, employment, medical, or professional licensing advice.
Students and clients should consult a qualified professional when they need advice in one of these areas.
15. Student and Client Conduct
Build Your English Academy may suspend or terminate services when a student, client, employee participant, or company representative:
-
Engages in harassment, discrimination, threats, or abusive conduct;
-
Creates an unsafe learning environment;
-
Repeatedly disrupts lessons;
-
Uses services for unlawful purposes;
-
Shares or misuses protected educational materials;
-
Fails to make required payments; or
-
Materially violates these Terms.
When reasonably possible, we will first communicate the concern and provide an opportunity to correct it.
If services are terminated because of serious misconduct or a material violation, completed services and reasonable costs already incurred will remain payable. Any refund for unused services will be determined under the Refund and Cancellation Policy and applicable law.
16. Third-Party Platforms and Links
We may use third-party services for scheduling, payment processing, video conferencing, email, course delivery, or website functionality.
Those services may have their own terms and privacy policies. Build Your English Academy is not responsible for the independent operation, availability, or content of third-party platforms.
Links to external websites are provided for convenience and do not necessarily constitute an endorsement.
17. Service Changes and Availability
We may make reasonable changes to schedules, teaching materials, platforms, instructors, or delivery methods when necessary.
If a material change prevents a student or client from receiving a purchased service, we will offer an appropriate replacement, account credit, rescheduling option, or refund.
We may temporarily suspend services because of illness, emergencies, severe weather, technology failures, or other circumstances outside our reasonable control.
18. Limitation of Liability
To the fullest extent permitted by law, Build Your English Academy will not be responsible for indirect, incidental, special, or consequential losses arising from the use of our services, website, materials, or third-party platforms.
Our total liability for a claim related to a purchased service will not exceed the amount paid for the specific service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
19. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful conduct, misuse of our materials, unauthorized recording or distribution, or material violation of these Terms.
This provision does not require a consumer to compensate Build Your English Academy for losses caused by the Academy’s own unlawful conduct or negligence.
20. Dispute Resolution
If a concern arises, students and clients agree to contact Build Your English Academy first and make a good-faith effort to resolve the matter informally.
If the matter cannot be resolved informally, these Terms will be governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Any legal proceeding will be brought in a court with proper jurisdiction in Virginia, unless applicable consumer law requires otherwise.
Nothing in this section prevents either party from using an applicable small-claims process or exercising a right that cannot legally be waived.
21. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, policies, or legal obligations.
The updated version will be posted with a revised effective date. Material changes will apply prospectively and will not reduce rights associated with services already purchased unless required by law or accepted by the affected client.
22. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
23. Entire Agreement
These Terms, together with the Refund and Cancellation Policy, Privacy Policy, invoice, enrollment information, and any applicable service agreement or proposal, constitute the agreement between the parties concerning the purchased services.
A company-specific agreement or proposal will control when it expressly conflicts with these general Terms.
24. Contact Us
Questions about these Terms and Conditions may be submitted through the contact information or contact form provided on the Build Your English Academy website.
